법칙결정(determination of rule of law)에서 그 법칙(rule of law) 궁금해서. 보통 영미법에서 법에의한 지배라고 표현하는데.. 그런 포괄적 범위를 나타내는 건지 아니면 국제법 그자체를 의미하는건지. 후자라면 38조 1항 (a)~(c)를 의미하는 건지
법의 일반원칙을 뜻하는 것 같음 예를들어, <1928년 호르죠공장사건>에서 상설국제재판소는 "조약의무의 위반이 있으면 배상을 수반하는 것은 법의 일반원칙이자 법의 기본개념."이라고 판시했는데 조약상 배상의무가 규정되어있지 않았는데도 '법의 일반원칙'을 통해 배상책임을 인정하였음.
법의 일반원칙은 제38조 1항 (c)에 나오지 않아?
