먼저 백라이트 개조에 대해서는 잘 모르겠으나 

쟁점이 되고있는 게임팩 롬 개조에 대해 알아봤음. 

하지만 본인은 법률적 지식은 없으니 어디까지나 참고하는 정도로 봐주길 바람 



문제가 될수있는 부분은 


1. 정품 롬을 소유하고 있는 경우 , 불법 롬 다운로드가 아니라 단순 패치도 불법이 될수 있는가 ? 

2. 개조 대행으로 금전적 이득을 취하고 있다면 , 문제가 되는가 ? 



1에 대해 닌텐도 공식 홈페이지에 나와 있는 문구를 보자면 

There is a good deal of misinformation on the Internet regarding the backup/archival copy exception. It is not a "second copy" rule and is often mistakenly cited for the proposition that if you have one lawful copy of a copyrighted work, you are entitled to have a second copy of the copyrighted work even if that second copy is an infringing copy. The backup/archival copy exception is a very narrow limitation relating to a copy being made by the rightful owner of an authentic game to ensure he or she has one in the event of damage or destruction of the authentic. Therefore, whether you have an authentic game or not, or whether you have possession of a Nintendo ROM for a limited amount of time, i.e. 24 hours, it is illegal to download and play a Nintendo ROM from the Internet.


노란색으로 색칠된 부분 :  정당한 롬의 소유자가 진품 게임의 손상 또는 파괴 시 복사본을 만드는것을 얼마 안되는 예외로 인정한다고 되어있다.

복사본을 만드는게 가능하다면 , 패치는 ? 원본 롬을 변조하는것은 합법일까?


If you do not use your legally purchased ROM, and patch it, it is illegal. As you do not physically, or legally OWN that specific ROM.

Now, if you take your legally owned copy of said ROM… Extract it… Then patch the ROM hack onto that ROM… It is not illegal, as you own the ROM.

ROM hacks are simply modified ROMS.

Even AP-Protected ROMS (anti-piracy) that you bypass using a ROM hack on would not be illegal, as you legally own said ROM.

But, do not fear the law when it comes to this. Unless you are selling the ROMS you obtained illegally(downloaded them from the internet)… It is very hard for the company whom released the game to get you in trouble.



롬 패치에 관한 구글 최상단에 뜨는 한 엔지니어의 답변을 보면  


정당한 롬 소유자가 그것을 추출해서 패치하는것은 불법이 아닐것이다 라고 답변하고 있다 

( 사실이 아닐수도 있음 )

According to all legal precedents, emulation is legal within the United States. ... So in the US, emulation is legal but downloading a copyrighted ROM from a random website is illegal. If you want to emulate with the maximum amount of legality, you'll have to dump your own ROMs directly from your cartridges.2


위와 같이 정당한 롬 소유자가 롬을 덤프하는것은 불법이 아니다라는 답변도 있음

(이것도 사실이 아닐수 있음)




1. 국내/국외 모두 합법

 

    : 백업을 목적으로 라이센스를 가진 소프트(게임)의 백업본을 만드는 행위

    : 라이센스를 가진 소프트의 백업본을 구동하는 행위

    : 라이센스를 가진 소프트의 백업본을 개인적인 공간(온라인 포함)에 보관하는 행위


이런 내용도 있고..  




크리스탈 팩 개조는 정품 롬을 소유한 사람이 정품 롬을 인계해서 정품 롬을 추출해 새로운 기판에 덤프하고 ( 공유가 아님 . 본인 사용 목적의 덤프)
기존 롬을 파기하니까 위에 언급한 합법성을 모두 갖춘게 아닌가 함. (내 생각임)





그렇다면 마지막으로 롬 개조에 대해 금전적 이득을 취하는 것은 합법일까 ? 



이건 찾아봐도 안나오네 . .근데 합법적인 행위를 단순히 대행해줬다고 해서 불법이란 생각은 들지 않는데
